The objectives of this course are:

1. To develop the analytical and critical skills by detailed examination of global creative industry, relevant international IP treaties, other legal instruments, and case law concerning the relations between the IP rights and creative industry;

2. To develop the written and oral skills of students through class discussion and written assessments.

This course has four main parts. First of all, it considers what global creative industry is and why creators need to understand intellectual property rights. The second part of this course focuses its attention on industrial design, looking at how legal rules concerning design patent are applied to protect designs. The third part of this course analyses the relationships between copyright and creative industry, in particular how copyright law can be applied to secure protection for artistic works, literal works, films, and sound recordings. Also, this part of the course examines the distinction between copyright and industrial designs. The fourth and final part considers trade mark protection for the creations. It looks at how the trade mark law regime has operated during the past few decades. Among other important issues, this part of the course analyses the rights of trade mark owners as well as the scope of protection for well-known marks.
